I wouldn't be surprised if bug 526394 fixes this.

Indeed. Changeset 4ccff5df452c, "Bug 526394. Part 31: Move scroll implementation into nsGfxScrollFrame.", removed this assertion. Filed bug 539348 on another assertion that can be triggered using this testcase.
